PRIVACY POLICY

The following sets forth the policies for the collection and use of personally identifiable information (“Information”) by Message Mediums, LLC, DBA Interactive Mediums (“Interactive Mediums”) in connection with its operation of its Web sites located at http://textme.net and http://textmeforbusiness.com (the “Sites”) and with its private label message services operated on behalf of third parties (its “Clients”), and supersedes any previous statement of such policies.  (In this policy, the Sites and the private label services are collectively known the “Business.”)  Interactive Mediums takes its obligations regarding privacy very seriously, and it wants to ensure users are fully informed about the Information they are providing to it.

Collection of Information
In connection with the Business, Interactive Mediums may collect Information in the following ways:
  • Through forms filled out by a user on the Sites or on Web sites operated by or on behalf of Clients.
  • Through SMS (Short Message Service) messages sent via the user’s cellular phone to short codes provided by Interactive Mediums or its Clients
  • Through Information provided by a user in connection with surveys and prize promotion entries
  • Through Information provided by Clients about users
  • Through the maintenance and analysis of Web server logs
  • Via e-mail and other communications between a user and Interactive Mediums
Interactive Mediums may also collect non-personally identifiable information from users via “cookies” (small text files placed by Interactive Mediums on user computers), single-pixel GIF image files (also called “Web beacons”), Web server log analysis and other similar technological means.  Such information may be used to track site trends and enhance the user experience, and may be shared with third parties.

To the extent third parties may place advertising on the Sites, such third parties may utilize cookies or other technological means within the advertising to collect and utilize non-personally identifiable information.  Interactive Mediums is not responsible for information collected by third parties in this manner, nor for the collection or use of Information by other sites to which the Sites are linked.

Types of Information Collected by Interactive Mediums
The following types of Information about a user are among those that may be collected by Interactive Mediums in connection with the Sites:
  • Name
  • Postal address
  • E-mail address
  • Telephone number
  • Mobile phone number
  • Physical location
  • Age
  • Date of birth
  • Gender
  • IP Address
  • Referring site
  • Other technical information collected by the Sites’ servers.
No Collection of Information from Children
The Sites are not intended for users under the age of 18, nor does Interactive Mediums knowingly collect or retain Information in connection with the Sites from children under the age of 13.

Use of Information
Interactive Mediums may use Information collected in connection with the Sites in the following ways:
  • To provide requested information, products and services to users via the Sites or through other online or offline channels
  • To enable users to enter prize promotions and receive prizes from Interactive Mediums and/or third parties
  • To improve the user experience with the Sites
  • In connection with the operation of the Sites
  • For users to obtain information and offers for products and services offered by Interactive Mediums as well as selected third parties.
In order to do the foregoing, Interactive Mediums may provide the Information to trusted third parties, including but not limited to Clients, selected third party marketers and vendors as well as third party contractors providing services to Interactive Mediums such as the operation of the Sites, communication services and fulfillment of orders, and information verification.  Interactive Mediums will use commercially reasonable efforts to limit use of the Information by such third parties to the specific uses set forth above.  Interactive Mediums also utilizes electronic and physical security to reduce the risk of improper access to or manipulation of Information during transmission and storage, but cannot guarantee the security or integrity of the Information and shall have no liability for breaches of security or integrity or third-party interception in transit.

Interactive Mediums may also disclose Information to affiliated entities, when it determines it is necessary to comply with applicable laws or regulations, in connection with a merger, acquisition, asset purchase or sale of or by Interactive Mediums, or to protect the interests or safety of Interactive Mediums, its customers, or other visitors to the Sites.

Wireless Policy
Pursuant to the above, Interactive Mediums and its Clients may use Information to provide the services requested by a user, including utilizing a provided cell phone number for voice communication with the user and services that display customized content and advertising via SMS messages sent to such provided cell phone number. In addition to any fee of which a user is notified, the user’s provider's standard messaging rates apply to confirmation and all subsequent SMS correspondence.  All standard messaging charges are billed by and payable to the user’s mobile service provider. Neither Interactive Mediums nor its Clients will be liable for any delays or errors in the delivery of any SMS messages, as delivery is subject to effective transmission from the user’s network operator.  SMS message services are provided on an AS IS basis.

Opting Out from Offers from Interactive Mediums
At any time, a user may discontinue receiving SMS offers from Interactive Mediums by sending the SMS message STOP ALL to the applicable shortcode.  Additionally, a user may discontinue receiving offers from a particular client by sending the SMS message STOP to that Client’s particular shortcode or by following other instructions provided by that Client.  Opting out from a particular Client’s offers will not apply to any communications from other Clients or third parties to which Interactive Mediums may have provided Information regarding the user.  Third parties’ use of the Information is subject to such parties’ own privacy policies, for which Interactive Mediums shall not be responsible.

Access to Information
All users who provide their Information to Interactive Mediums may modify and correct such Information by e-mailing us at support@interactivemediums.com.  Please refer to each Client’s own privacy policy for instructions on accessing Information retained by that Client.

Your California Privacy Rights
Beginning on January 1, 2005, California Civil Code Section 1798.83 permits customers of Interactive Mediums who are California residents to request certain information regarding Interactive Mediums’ disclosure of personal information to third parties for such third parties’ direct marketing purposes. Changes to this Privacy Policy
Interactive Mediums reserves the right to revise and update this Privacy Policy at any time.  Any such revisions will be effective on the date of posting to the Sites, and will apply to all information collected by Interactive Mediums both prior to and following the effective date. Your use of the Sites following any such revisions will be deemed your acceptance of such revisions. Users should periodically visit this page to review the current policies with regard to Information.
